ANNOUNCEMENT

The Mayor, Councillor T. O’Leary, at the start of the meeting, reminded Members that Standing Orders would apply to all aspects of the meeting.

The Mayor then read out the following Planning Statement. “The proposed variations to the County Development Plan 2023-2029 before you at this meeting were prepared in accordance with Section 13 of the Planning and Development Act, 2000, as amended.

It is important as we commence considering same, that I remind members, in accordance with Section 13 (7) of the Act, that, In making a variation under this section, the members of the authority shall be restricted to considering the proper planning and sustainable development of the area to which the development plan relates, the statutory obligations of any local authority in the area and any relevant policies or objectives for the time being of the Government or any Minister of the Government.

Furthermore, and having regard to recent Court judgements, members need to be aware, that only planning considerations can be taken into account. Please be mindful not to bring up significant non-planning considerations or personal considerations in your contributions as this may affect the legal robustness of the variations to the Development Plan. On this basis, if irrelevant comments are made during the meeting, the Chair will seek to bring these to the members attention and request that they withdraw their comments and/or inform the meeting that the comments should be disregarded. However, members remain responsible for their comments and should not introduce non-planning considerations.

As you are aware, a planning rationale is required for each motion, this also should be included in any proposed amendment to a motion before you on the Agenda.”
